The questions injured clients ask us most — answered the way we would answer them on the phone.
01How long do I have to file a claim?
+
Deadlines vary by state — commonly one to three years from the date of injury — and claims against a government entity can require written notice in as little as a few months. Lemon law and wrongful death claims follow their own timelines. Because a missed deadline ends a case permanently, get advice early rather than close to the line.
02What if I was partly at fault for the accident?
+
Most states follow comparative fault rules, so you can usually still recover even if you share responsibility — your recovery is reduced by your percentage of fault. Insurers routinely overstate that percentage, which is exactly what a prepared case pushes back against.
03Do I have to pay anything upfront?
+
No. Injury cases are handled on a contingency basis. We advance the costs of building your case — investigators, records, experts, filing fees — and we are paid only out of what we recover. If we do not win, you owe us nothing for our time.
04How long does a settlement take?
+
Straightforward claims can resolve in a few months once treatment is complete. Serious injury or disputed liability cases take longer, and filing suit adds time. Settling before your medical picture is clear is usually the costlier choice.
05What if the driver who hit me had no insurance?
+
Your own uninsured/underinsured motorist coverage may respond, including in hit-and-run cases. We review every policy in your household, along with any employer or commercial coverage that may apply.
06Will my case actually end up in court?
+
Most cases settle. We prepare each one as though it will not — that readiness is what moves offers. If the best offer is still unfair, we are prepared to take it further, and you decide whether to accept or proceed.
